Legal review finds no problem with override veto on Schenectady judgeship

SCHENECTADY – No deadline restricts when the City Council can vote to override a mayoral veto, an outside law firm wrote in an opinion prompted by Mayor Gary McCarthy’s assertion lawmakers waited to long to reverse his effort to cut a city judgeship.

City leaders may override a mayor’s veto “within any reasonable time” after being formally notified of the action by the city clerk and are not bound by a specific deadline, Michael Whiteman of Whiteman, Osterman & Hanna in Albany wrote.

The opinion is the latest development in an ongoing battle that pits McCarthy against City Council President Ed Kosiur and Kosiur’s fellow Democrats on the council over how many judges sit in City Court.
